Welcome to myuser.ai. These Terms of Service ("Terms") govern your use of the myuser.ai application ("Service") operated by myuser.ai LLC ("we", "our", or "us").
By installing and using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our Service.
myuser.ai is an AI-powered marketing automation platform that integrates with your Shopify or Wix store to:

You are responsible for maintaining the security of your Shopify or Wix account and any credentials used to access our Service. You must notify us immediately of any unauthorized access.

You must ensure that you have obtained proper consent from your customers before sending them marketing communications through our Service. You are responsible for maintaining records of such consent.
While we use AI to generate marketing content, you are ultimately responsible for reviewing and approving all messages sent through our Service. You should review AI-generated content for accuracy and appropriateness.
myuser.ai sends SMS and MMS text messages on behalf of merchants who use our Service ("the messaging program"). These Terms, together with our Privacy Policy, govern that program. By providing your mobile phone number to a merchant using myuser.ai (for example, by entering it in a sign-up or checkout form on the merchant's store), you consent to receive recurring automated marketing and transactional text messages from that merchant at the number provided.
Consent to receive text messages is not a condition of any purchase. Merchants using our Service are responsible for obtaining and maintaining valid opt-in consent from their customers before any messages are sent (see Section 4.2).
Our Service uses artificial intelligence (OpenAI) to generate marketing content. You acknowledge that:
The Service is offered on a free plan and on paid subscription plans. The plans available to you, what each one includes, and their current prices are shown on our app store listing — the Shopify App Store or the Wix App Market — and on the Plan page inside the app. You will always see the price and what it covers before you subscribe.
All charges for the Service are processed through the billing system of the platform you installed from, Shopify or Wix, and appear on that platform’s regular invoice. We do not collect or store your payment card details. Paid plans are billed on a recurring basis, monthly or annually depending on the option you select, and renew automatically until cancelled.
Paid plans may include a free trial. A trial is available only on a new subscription and cannot be added to a subscription that is already running. Unless you cancel before the trial ends, your subscription continues automatically and the first charge is taken when the trial period expires. The length of any trial is shown before you approve the subscription.
Paid plans include monthly allowances (for example contacts, email sends, text messages and session recordings). Usage beyond an allowance on a paid plan is charged, on Shopify, at the per-unit rates shown in the app and on our App Store listing, and is added to the same Shopify subscription as usage charges. On Wix there are no usage charges: an allowance is a cap, and the relevant feature waits until the allowance resets or you move to a larger plan.
Where usage charges apply, they are subject to a monthly limit that you approve together with your subscription. We will not bill usage above that limit; raising it requires a new approval from you through Shopify.
On the free plan, allowances are hard caps rather than billable overages: there are no usage charges, and the relevant feature stops until the allowance resets or you move to a paid plan.
Some plans offer optional add-ons that increase a monthly allowance. Add-ons are billed as part of the same recurring subscription and are shown with their price before you add them. Add-ons are not available for subscriptions purchased through Wix.
Subscriptions billed through Shopify. You can change or cancel your plan at any time from the Plan page in the app, without contacting us. Moving to a higher-priced plan takes effect immediately, and Shopify applies any credit for the unused portion of your current plan under its own billing rules. Moving to a lower-priced plan, moving to the free plan, or cancelling takes effect at the end of your current billing period: you keep the features of your current plan until that date and are not charged again. Uninstalling the app from Shopify cancels your subscription automatically.
Subscriptions purchased through Wix. The available plans, prices, billing frequency, trial terms, and renewal details are shown on Wix’s pricing and checkout pages, and Wix processes the subscription payment. The app’s Plan page links to Wix to view plans and manage billing. Cancel renewal through Premium Subscriptions in your Wix account; cancellation does not require contacting myuser.ai. Subject to the subscription status confirmed by Wix, paid access remains available through the current paid period. Removing the app or requesting data erasure does not cancel the subscription. To move to a lower plan, cancel renewal and purchase the lower plan after the current subscription expires. Wix displays the applicable charge and renewal terms; do not assume Shopify upgrade credits, add-ons, or cancellation rules apply.
We may give a store access to a paid plan at no charge — for example, stores that installed the Service before paid plans existed ("founding" stores). A complimentary plan carries the same allowances and features as the paid plan it mirrors, and no charge is raised for it. Unless the specific offer states a fixed term, it lasts for as long as the Service remains installed on that store. It is not transferable to another store.
The partner referral offer gives eligible new Wix merchants 60 days of complimentary access to a paid plan from a successful claim. It does not create a paid subscription or authorize automatic billing. Its eligibility, duration, and referral conditions are described in the Partner Terms of Service, which control that offer. Referral partners separately accept those terms when activating their partner accounts.
We may change or withdraw a complimentary plan, including on notice to you, for example if the plan is discontinued, if the Service is used in breach of these Terms, or if the account is used to abuse the allowance. If we withdraw it, we will tell you before it ends and you may move to any paid plan or continue on the free plan. Uninstalling the app ends a complimentary plan; reinstalling does not guarantee it is restored.
We may change our prices or the contents of a plan. Changes apply from your next renewal, and any increase to an existing subscription requires your approval through your store platform before it takes effect — we cannot raise the price of a subscription you have already approved. If you do not approve a change, you may continue on your existing terms until the end of your billing period or move to another plan.
Except where required by law, charges are non-refundable, including for partial billing periods and for unused allowances. Where a refund is due or we agree to issue one, it is processed through your store platform. Prices are exclusive of any applicable taxes, which are handled by that platform’s billing system.
The Service, including its original content, features, and functionality, is owned by myuser.ai LLC and is protected by copyright, trademark, and other intellectual property laws.
You retain ownership of your content (templates, images, etc.) that you upload to our Service. By uploading content, you grant us a license to use it to provide the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, myuser.ai SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Our total liability shall not exceed the amount you paid us in the past 12 months.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee that:
You agree to indemnify and hold harmless myuser.ai and its officers, directors, employees, and agents from any claims, damages, or expenses (including attorney's fees) arising from:
We may terminate or suspend your access to our Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
