Welcome to myuser.ai. These Terms of Service ("Terms") govern your use of the myuser.ai application ("Service") operated by myuser.ai LLC ("we", "our", or "us").

By installing and using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use our Service.

1. Description of Service

myuser.ai is an AI-powered marketing automation platform that integrates with your Shopify store to:

• Analyze customer behavior and purchase patterns
• Generate personalized marketing emails and SMS messages
• Automate marketing campaigns based on customer actions
• Provide analytics and insights on marketing performance

2. Account and Access

2.1 Eligibility

You must be at least 18 years old and have a valid Shopify store to use our Service. By using our Service, you represent that you meet these requirements.

2.2 Account Security

You are responsible for maintaining the security of your Shopify account and any credentials used to access our Service. You must notify us immediately of any unauthorized access.

3. Use of Service

3.1 Permitted Use

You may use our Service to:

• Send legitimate marketing communications to your customers
• Analyze your customer data for marketing purposes
• Create and manage email and SMS templates

3.2 Prohibited Use

You may not use our Service to:

• Send spam or unsolicited messages
• Violate any applicable laws or regulations (including CAN-SPAM, GDPR, TCPA)
• Infringe on the intellectual property rights of others
• Transmit malicious code or attempt to compromise our systems
• Send messages to customers who have not consented to receive them
• Misrepresent your identity or the source of messages

4. Your Responsibilities

4.1 Compliance with Laws

You are responsible for ensuring your use of our Service complies with all applicable laws, including:

• CAN-SPAM Act (United States)
• GDPR (European Union)
• CASL (Canada)
• TCPA for SMS communications
• Any other applicable local laws

4.2 Customer Consent

You must ensure that you have obtained proper consent from your customers before sending them marketing communications through our Service. You are responsible for maintaining records of such consent.

4.3 Content Responsibility

While we use AI to generate marketing content, you are ultimately responsible for reviewing and approving all messages sent through our Service. You should review AI-generated content for accuracy and appropriateness.

5. SMS / Text Messaging Program

myuser.ai sends SMS and MMS text messages on behalf of merchants who use our Service ("the messaging program"). These Terms, together with our Privacy Policy, govern that program. By providing your mobile phone number to a merchant using myuser.ai (for example, by entering it in a sign-up or checkout form on the merchant's store), you consent to receive recurring automated marketing and transactional text messages from that merchant at the number provided.

• Program description: messages may include welcome offers, abandoned-cart reminders, product recommendations, order and account notifications, promotions, and related updates.
• Message frequency: message frequency varies based on your activity and the sending merchant's settings; you may receive recurring messages.
• Cost: Message and data rates may apply. myuser.ai and the sending merchant do not charge for the messages themselves, but your mobile carrier's standard rates apply.
• Opt-out: you can cancel at any time by replying STOP to any message. After you send STOP, you will receive one confirmation message and then no further messages from that program. You may also reply UNSUBSCRIBE to the same effect.
• Help: reply HELP for assistance, or contact us at support@myuser.ai.
• Carriers: carriers are not liable for delayed or undelivered messages.
• Eligibility: the program is intended for recipients in the United States who are the account holder of, or have authority to consent for, the mobile number provided.

Consent to receive text messages is not a condition of any purchase. Merchants using our Service are responsible for obtaining and maintaining valid opt-in consent from their customers before any messages are sent (see Section 4.2).

6. AI-Generated Content

Our Service uses artificial intelligence (OpenAI) to generate marketing content. You acknowledge that:

• AI-generated content may occasionally contain errors or inaccuracies
• You should review all content before sending to customers
• We are not responsible for any damages arising from AI-generated content
• Customer data is shared with OpenAI to generate personalized content

7. Pricing and Payment

Our Service is offered as a paid subscription through the Shopify Billing API. Details of our pricing plans are available in the Shopify App Store and within the app. By subscribing, you agree to pay the applicable fees.

• Subscription fees are billed through Shopify
• You may cancel your subscription at any time
• Refunds are handled according to Shopify's policies

8. Intellectual Property

8.1 Our Property

The Service, including its original content, features, and functionality, is owned by myuser.ai LLC and is protected by copyright, trademark, and other intellectual property laws.

8.2 Your Content

You retain ownership of your content (templates, images, etc.) that you upload to our Service. By uploading content, you grant us a license to use it to provide the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYUSER.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data
• Loss of business opportunities
• Damages arising from undelivered or delayed messages
• Damages arising from AI-generated content

Our total liability shall not exceed the amount you paid us in the past 12 months.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

• The Service will be uninterrupted or error-free
• All messages will be delivered successfully
• AI-generated content will be accurate or appropriate
• The Service will meet your specific requirements

11. Indemnification

You agree to indemnify and hold harmless myuser.ai and its officers, directors, employees, and agents from any claims, damages, or expenses (including attorney's fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any applicable laws
• Content you create or send through the Service

12. Termination

We may terminate or suspend your access to our Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will cease immediately
• We may delete your data according to our Privacy Policy
• You will not be entitled to any refund of fees paid

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.
